Sponsoring & Hiring Foreign Nationals

If you are a skilled worker and citizen of a country outside of the EEA (European Economic Area) and want to live and work in the UK, then you need to apply for the Tier 2 visa, which replaces the need for a work permit in the country. The only requirement is that a UK-based company acts as a sponsor.

There are 4 subcategories of Tier 2 migrants:

  • Tier 2 (General) – Those are skilled individuals that enter the UK to fill a gap in a UK business that no settled worker can. You earn points according to your competence in the English language, availability of maintenance funds, sponsorship, and salary. It might also be required that the role offered passes a Resident Labour Market Test, which dictates how and where to advertise vacancies before a UK employer can sponsor you, if your role is not listed as a “Shortage Occupation” or if you do not meet the exemption criteria. In this case, the job that requires the test is advertised for, at least, 28 days.
  • Tier 2 (Intra-Company Transfer) – They are employees of multi-national organisations that are being transferred to a UK branch of the corporation, either on a short-term or long-term basis.
  • Tier 2 (Sportsperson) – This subcategory includes highly-esteemed and world-renowned sports individuals, whose contribution to the development of their sport in the UK is considered valuable.
  • Tier 2 (Minister of Religion) – These are people that wish to undertake a religious role within their faith communities in the UK (i.e. missionaries or ministers of religion with pastoral work).
